Terms of Service

1 Acceptance of Terms

By downloading, installing, or using the WowText application ("App") or visiting wowtextapp.com ("Website"), you ("User," "you," or "your") agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy, which are incorporated herein by reference.

These Terms constitute a binding legal agreement between you and LINKSYNC MZ LTD ("WowText," "we," "us," or "our"). If you do not agree to all of these Terms, you must not use our Service.

2 Description of Service

WowText provides a virtual US phone number service ("Service") that allows registered users to:

• Obtain a dedicated, real US telephone number
• Send and receive SMS text messages through that number
• Make and receive voice calls via VoIP (Voice over Internet Protocol)
• Receive one-time passwords (OTP) and verification codes from third-party platforms
• Optionally obtain international virtual phone numbers for supported countries

The Service is delivered through our mobile application available on iOS (Apple App Store) and Android (Google Play Store), and operates over WiFi or mobile data. No physical SIM card is required.

WowText is a communications platform. We are not a licensed telecommunications carrier. Voice calls are transmitted as VoIP and quality may vary depending on internet connection speed and stability.

3 Eligibility

To use the Service, you must meet all of the following requirements:

• You must be at least 18 years of age, or the age of majority in your jurisdiction, whichever is higher
• You must have the legal capacity to enter into a binding contract
• You must not be located in a country that is subject to a U.S. government embargo or trade sanction
• You must not be listed on any U.S. government list of prohibited or restricted parties
• You must not have been previously banned from using the Service

By using the Service, you represent and warrant that you meet all eligibility requirements listed above. WowText reserves the right to verify eligibility and to refuse service to any person at any time.

4 Account & Registration

To access the Service, you must create an account. When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

• You may not share your account credentials with any third party
• You must notify us immediately of any unauthorized access to your account
• Each user may only maintain one active account
• You are solely responsible for any activity that occurs under your account

WowText will not be liable for any loss or damage arising from your failure to keep your account credentials secure.

5 Subscriptions & Billing

WowText offers paid subscription plans and one-time consumable purchases. Current pricing is displayed within the App and on our website. All prices are in USD unless otherwise stated.

Subscription Plans:

• Standard ($4.99/month): Dedicated US number, unlimited incoming SMS and OTP codes, incoming call notifications. 30-day validity.
• Medium ($8.00/month): All Standard features plus 1,000 outbound/inbound messages and 5 call credits per month.
• Premium ($25.00/month): All Medium features plus 3,000 messages, 10 call credits, 10DLC registration, and business SMS approval.

Billing: Subscriptions are billed on a 30-day cycle through the platform you purchased from (Apple App Store or Google Play). Payment is charged to the payment method on file with your respective platform account. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

Consumable Purchases: Call credits, message top-ups, and recharge packs are one-time purchases that do not expire while your number remains active.

6 Refund Policy

All purchases made through WowText are processed by Apple App Store or Google Play, and are subject to their respective refund policies:

• Apple App Store: Refund requests must be submitted to Apple at reportaproblem.apple.com within 90 days of the original charge.
• Google Play: Refund requests must be submitted to Google Play within 48 hours of purchase for instant refunds, or through Google's support team thereafter.

WowText does not issue refunds directly. Notwithstanding the above, if you experience a significant technical failure caused by our platform that renders the Service completely unusable, you may contact our support team and we will work with you to find a fair resolution, which may include service credit at our sole discretion.

Subscriptions that have already been used, partially used, or where a phone number has been issued are generally not eligible for refund.

7 Acceptable Use

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. Permitted uses include:

• Personal privacy protection — keeping your real number private
• Account verification for legitimate third-party services
• Business communications and customer contact
• Receiving OTP codes for platforms you own or have authorized access to
• Online marketplace transactions (buying/selling)
• Two-factor authentication for your own accounts

You are responsible for all content you send using the Service and for ensuring your use complies with all applicable local, national, and international laws and regulations.

8 Prohibited Activities

The following activities are strictly prohibited and will result in immediate account termination, reporting to relevant authorities, and potential legal action:

• Sending spam, unsolicited bulk messages, or mass marketing without consent
• Harassment, threats, abuse, or intimidation of any person
• Fraud, impersonation, phishing, or any deceptive practice
• Using the Service to bypass fraud detection systems you are not authorized to bypass
• Selling or reselling virtual numbers to third parties without authorization
• Using the Service to violate any third party's terms of service (e.g., creating fraudulent accounts)
• Transmitting illegal content including but not limited to content that violates child protection laws
• Using automated scripts, bots, or scrapers to interact with the Service
• Attempting to reverse-engineer, hack, or disrupt the Service or its infrastructure
• Using the Service for telemarketing without proper regulatory compliance (e.g., TCPA)
• Transmitting content that violates any applicable law or regulation
• Attempting to obtain phone numbers for the purpose of SIM-swap fraud or account takeover

9 User Content & Your Responsibility

WowText acts solely as a neutral, passive technology platform and communications conduit. We transmit messages and calls that you and other users originate. We do not create, author, monitor, pre-screen, edit, endorse, or control the content of any message, call, or communication sent or received through the Service.

To the fullest extent permitted by law, including Section 230 of the U.S. Communications Decency Act (47 U.S.C. § 230) and the "mere conduit" provisions of applicable UK and EU electronic-commerce law, WowText shall be treated as a provider of an interactive computer service and an intermediary, and shall not be treated as the publisher, author, or speaker of any user content.

You represent, warrant, and covenant that, for everything you transmit through the Service:

• You own or have all rights, licenses, consents, and permissions necessary to send it;
• It does not infringe, misappropriate, or violate any third party's intellectual property, privacy, publicity, or other rights;
• It is not unlawful, defamatory, fraudulent, threatening, harassing, obscene, or otherwise objectionable;
• It complies with all applicable laws, regulations, and third-party terms; and
• Its transmission will not give rise to any claim, liability, or loss for WowText.

WowText assumes no liability whatsoever for any user content or for any act or omission of any user. Any use you make of user content, and any reliance you place on the Service, is strictly at your own risk. We reserve the right (but assume no obligation) to remove, block, or refuse to transmit any content, and to suspend any account, at our sole discretion and without liability.

10 Messaging & Telephony Compliance

You are solely responsible for ensuring that every message and call you send through the Service complies with all applicable laws, regulations, and industry standards. You acknowledge that the legal responsibility for the content, purpose, frequency, and recipients of your communications rests entirely with you as the sender.

Without limitation, you represent and warrant that your use of the Service complies with all of the following where applicable:

• The Telephone Consumer Protection Act (TCPA) and all FCC regulations governing calls and text messages;
• The CAN-SPAM Act and equivalent anti-spam laws;
• The CTIA Messaging Principles & Best Practices and carrier A2P / 10DLC registration requirements;
• All federal, state, and internal Do-Not-Call (DNC) list obligations;
• UK PECR, GDPR/UK GDPR, and all applicable international communications and data-protection laws.

You agree to defend and indemnify WowText against any and all claims, fines, penalties, and losses arising from your communications, as set out in Section 17 (Indemnification). WowText is not responsible for obtaining consent on your behalf, for the regulatory classification of your traffic, or for any blocking, filtering, or penalty imposed by a carrier or regulator as a result of your activity.

11 Phone Numbers

Virtual phone numbers provided by WowText are assigned to you for the duration of your active subscription. Please be aware of the following:

• Numbers are leased, not owned. WowText retains ownership of all phone numbers.
• Numbers cannot be transferred, ported out, or sold to third parties.
• The same number may be reassigned to another user after your subscription expires and a standard recycle period has passed.
• WowText cannot guarantee the perpetual availability of any specific number.
• Numbers are subject to carrier regulations and may be reclaimed by the underlying carrier in rare circumstances outside our control.
• Renewing your subscription before expiry is the best way to retain your assigned number.

Message limits and call credits reset at the beginning of each billing cycle and do not carry over. Unused credits from consumable purchases do not expire while your number remains active.

12 Emergency Services & 911 Limitations

The Service does not support and cannot be used to place calls to 911, 112, 999, or any other emergency or public-safety answering service. Calls to emergency numbers may fail, may not connect to the correct emergency center, and may not transmit your location or call-back number.

You expressly acknowledge and agree that:

• You must at all times maintain an alternative means of accessing emergency services (such as a mobile phone with cellular service or a traditional landline);
• WowText has no obligation to provide emergency-calling capability and makes no representation that it does;
• You will inform anyone who may use your device or number of this limitation; and
• To the fullest extent permitted by law, WowText, its affiliates, suppliers, and carriers shall have no liability whatsoever for any loss, injury, death, or damage arising from the inability to reach emergency services through the Service.

You agree to defend and indemnify WowText against any claim by you or any third party arising out of or relating to the unavailability of emergency calling through the Service.

13 Third-Party Platforms & No Guarantee of Acceptance

Many third-party platforms, websites, banks, and applications (for example, certain messaging apps, social networks, financial institutions, and online services) restrict, filter, or prohibit the use of virtual, VoIP, or non-mobile telephone numbers for registration, verification, or two-factor authentication.

WowText does not control these third parties and makes no representation, warranty, or guarantee that any virtual number obtained through the Service will be accepted by, will receive codes from, or will continue to work with any particular third-party platform.

• We are not responsible for any third party's decision to block, ban, reject, deactivate, or rate-limit your number;
• We are not responsible for the non-delivery, delay, or filtering of OTP/verification codes by a sender or intermediary outside our control;
• A third party's refusal to accept your number is not a defect in the Service and does not entitle you to a refund; and
• You are responsible for ensuring your intended use complies with the terms of service of any third-party platform you interact with.

14 Privacy

Your privacy is critically important to us. Our full Privacy Policy is available at wowtextapp.com/privacy-policy.html and is incorporated into these Terms by reference.

By using the Service, you acknowledge and agree that:

• We collect certain information necessary to provide the Service as described in our Privacy Policy
• Message content transmitted through the Service may be stored temporarily for delivery purposes
• We may disclose your information when required by law or valid legal process
• We implement industry-standard security measures to protect your data

15 Termination

Either party may terminate this agreement at any time.

You may cancel: Cancel your subscription at any time through the App Store or Google Play subscription management settings. Your Service will remain active until the end of the current billing period.

We may suspend or terminate: WowText reserves the right to suspend or permanently terminate your account, without notice and without refund, if we determine at our sole discretion that you have:

• Violated any provision of these Terms
• Engaged in fraudulent, abusive, or illegal activity
• Caused harm to other users or third parties through use of the Service
• Failed to pay applicable subscription fees
• Provided false information during registration

Upon termination, your right to use the Service immediately ceases and your assigned phone number will be released.

16 Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any message or call will be delivered, timely, or accurate.

To the maximum extent permitted by applicable law, WowText and its parent, affiliates, officers, directors, employees, agents, suppliers, and carriers (the "WowText Parties") shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, or data, whether based in contract, tort, negligence, strict liability, or otherwise, including but not limited to liability arising from:

• Any user content or the acts or omissions of any user or third party
• Service interruptions, message or call delivery failures, or loss of data
• Unauthorized access to, or alteration of, your account, transmissions, or data
• The inability to access emergency services (see Section 12)
• Actions taken by third-party platforms, carriers, or regulators based on communications through the Service
• Any matter beyond our reasonable control

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as liability for death or personal injury caused by negligence, or for fraud). In such cases, our liability is limited to the maximum extent permitted by law. These limitations apply even if a remedy fails of its essential purpose and survive termination of these Terms.

17 Indemnification

You agree to defend, indemnify, and hold harmless the WowText Parties (LINKSYNC MZ LTD and its parent, affiliates, officers, directors, employees, agents, suppliers, and carriers) from and against any and all claims, demands, actions, investigations, liabilities, damages, judgments, settlements, losses, costs, and expenses (including reasonable attorneys' and legal fees) arising out of or relating to:

• Your access to or use (or misuse) of the Service;
• Any content, message, call, or communication you create, transmit, request, store, or receive through the Service;
• Your violation of these Terms or any policy incorporated by reference;
• Your violation of any applicable law or regulation (including the TCPA, CAN-SPAM, anti-spam, telemarketing, consumer-protection, privacy, or data-protection laws);
• Your violation or infringement of any right of any third party, including intellectual property, privacy, and publicity rights;
• Any claim that your content or communications caused harm, loss, or damage to a third party; and
• Any dispute between you and any other user or third party.

WowText reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims. You will not settle any claim without our prior written consent. This indemnification obligation survives the termination of these Terms and your use of the Service.

18 Force Majeure

WowText shall not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations that is caused by events outside its reasonable control ("Force Majeure Events"). These include, without limitation: acts of God, natural disasters, fire, flood, epidemic or pandemic, war, terrorism, civil unrest, government action or regulation, labor disputes, power or internet failures, carrier or telecommunications outages, third-party service or infrastructure failures, denial-of-service or other cyber attacks, and any other event beyond our reasonable control. During a Force Majeure Event our obligations are suspended, and we will not be liable for any resulting delay, interruption, or non-performance.

19 Intellectual Property & DMCA

The Service, including the App, Website, software, logos, trademarks, designs, text, and all related intellectual property, is owned by or licensed to LINKSYNC MZ LTD and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose, subject to these Terms. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works from any part of the Service.

We respect the intellectual property rights of others and expect users to do the same. If you believe content transmitted through the Service infringes your copyright, you may submit a notice to support@textwow.online with "DMCA Notice" in the subject line, including: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and its location; (d) your contact information; (e) a statement of good-faith belief that the use is unauthorized; and (f) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act. We will respond to valid notices and may remove content and terminate repeat infringers in appropriate circumstances.

20 Governing Law & Disputes

These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict-of-law principles.

Informal resolution first: Before initiating any formal dispute, you agree to contact us at support@textwow.online and attempt to resolve the matter informally. We will make reasonable efforts to resolve any dispute within 30 days of receiving your complaint.

Forum: Subject to the arbitration provision below, you and WowText agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute, and you submit to the personal jurisdiction of those courts.

Arbitration & class-action waiver: To the fullest extent permitted by applicable law, if informal resolution fails, any dispute shall be resolved by final and binding arbitration on an individual basis, and you and WowText each waive any right to a jury trial and any right to participate in a class action, class-wide arbitration, or representative proceeding.

You agree that any claim must be brought within one (1) year after the cause of action arises, or it is permanently barred, to the extent permitted by applicable law.

21 Changes to Terms

WowText reserves the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Send a notification through the App or via email where reasonably practicable
• Provide at least 7 days notice before material changes take effect

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Service.

22 General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy and any policies referenced herein, constitute the entire agreement between you and WowText and supersede all prior agreements and understandings.
• Severability: If any provision of these Terms is found unlawful, void, or unenforceable, that provision shall be severed or limited to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
• No Waiver: Our failure to enforce any right or provision shall not constitute a waiver of that or any other right or provision.
• Assignment: You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may freely assign these Terms, including in connection with a merger, acquisition, or sale of assets.
• Survival: Provisions that by their nature should survive termination — including User Content & Responsibility, Disclaimers & Limitation of Liability, Indemnification, Intellectual Property, and Governing Law & Disputes — shall survive.
• No Third-Party Beneficiaries: Except for the WowText Parties identified in these Terms, there are no third-party beneficiaries to this agreement.
• Headings: Section headings are for convenience only and have no legal effect.
